C\u1ee5 th\u1ec3 nh\u01b0 sau:<\/span><\/p>\n<p><b>1. Th\u1eddi gian l\u00e0m th\u00eam gi\u1edd<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Th\u1eddi gian l\u00e0m th\u00eam gi\u1edd l\u00e0 kho\u1ea3ng th\u1eddi gian l\u00e0m vi\u1ec7c ngo\u00e0i th\u1eddi gi\u1edd l\u00e0m vi\u1ec7c b\u00ecnh th\u01b0\u1eddng theo quy \u0111\u1ecbnh c\u1ee7a ph\u00e1p lu\u1eadt, th\u1ecfa \u01b0\u1edbc lao \u0111\u1ed9ng t\u1eadp th\u1ec3 ho\u1eb7c n\u1ed9i quy lao \u0111\u1ed9ng.<\/span><\/p>\n<p><b>2. \u0110i\u1ec1u ki\u1ec7n s\u1eed d\u1ee5ng ng\u01b0\u1eddi lao \u0111\u1ed9ng l\u00e0m th\u00eam gi\u1edd<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Ng\u01b0\u1eddi s\u1eed d\u1ee5ng lao \u0111\u1ed9ng \u0111\u01b0\u1ee3c s\u1eed d\u1ee5ng ng\u01b0\u1eddi lao \u0111\u1ed9ng l\u00e0m th\u00eam gi\u1edd khi \u0111\u00e1p \u1ee9ng \u0111\u1ea7y \u0111\u1ee7 c\u00e1c y\u00eau c\u1ea7u sau \u0111\u00e2y:<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">2.1. S\u1ef1 ch\u1ea5p thu\u1eadn c\u1ee7a ng\u01b0\u1eddi lao \u0111\u1ed9ng.\u00a0<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Ng\u01b0\u1eddi s\u1eed d\u1ee5ng lao \u0111\u1ed9ng c\u1ea7n ph\u1ea3i \u0111\u01b0\u1ee3c s\u1ef1 \u0111\u1ed3ng \u00fd c\u1ee7a ng\u01b0\u1eddi lao \u0111\u1ed9ng v\u1ec1 c\u00e1c n\u1ed9i dung sau \u0111\u00e2y:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Th\u1eddi gian l\u00e0m th\u00eam;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u0110\u1ecba \u0111i\u1ec3m l\u00e0m th\u00eam;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">C\u00f4ng vi\u1ec7c l\u00e0m th\u00eam.<\/span><\/li>\n<\/ul>\n<p><i><span style=\"font-weight: 400;\">2.2. B\u1ea3o \u0111\u1ea3m s\u1ed1 gi\u1edd l\u00e0m th\u00eam c\u1ee7a ng\u01b0\u1eddi lao \u0111\u1ed9ng\u00a0<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Th\u1eddi gian l\u00e0m th\u00eam c\u1ee7a ng\u01b0\u1eddi lao \u0111\u1ed9ng kh\u00f4ng qu\u00e1 50% s\u1ed1 gi\u1edd l\u00e0m vi\u1ec7c b\u00ecnh th\u01b0\u1eddng trong 01 ng\u00e0y; tr\u01b0\u1eddng h\u1ee3p \u00e1p d\u1ee5ng quy \u0111\u1ecbnh th\u1eddi gi\u1edd l\u00e0m vi\u1ec7c b\u00ecnh th\u01b0\u1eddng theo tu\u1ea7n th\u00ec t\u1ed5ng s\u1ed1 gi\u1edd l\u00e0m vi\u1ec7c b\u00ecnh th\u01b0\u1eddng v\u00e0 s\u1ed1 gi\u1edd l\u00e0m th\u00eam kh\u00f4ng qu\u00e1 12 gi\u1edd trong 01 ng\u00e0y; kh\u00f4ng qu\u00e1 40 gi\u1edd trong 01 th\u00e1ng;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">B\u1ea3o \u0111\u1ea3m s\u1ed1 gi\u1edd l\u00e0m th\u00eam c\u1ee7a ng\u01b0\u1eddi lao \u0111\u1ed9ng kh\u00f4ng qu\u00e1 200 gi\u1edd trong 01 n\u0103m. Tr\u1eeb tr\u01b0\u1eddng h\u1ee3p m\u1ed9t s\u1ed1 ng\u00e0nh ngh\u1ec1, c\u00f4ng vi\u1ec7c \u0111\u1eb7c th\u00f9, ng\u01b0\u1eddi s\u1eed d\u1ee5ng lao \u0111\u1ed9ng \u0111\u01b0\u1ee3c s\u1eed d\u1ee5ng ng\u01b0\u1eddi lao \u0111\u1ed9ng l\u00e0m th\u00eam kh\u00f4ng qu\u00e1 300 gi\u1edd trong 01 n\u0103m, c\u1ee5 th\u1ec3 c\u00e1c tr\u01b0\u1eddng h\u1ee3p sau:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">S\u1ea3n xu\u1ea5t, gia c\u00f4ng xu\u1ea5t kh\u1ea9u s\u1ea3n ph\u1ea9m h\u00e0ng d\u1ec7t, may, da, gi\u00e0y, \u0111i\u1ec7n, \u0111i\u1ec7n t\u1eed, ch\u1ebf bi\u1ebfn n\u00f4ng, l\u00e2m, di\u00eam nghi\u1ec7p, th\u1ee7y s\u1ea3n;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">S\u1ea3n xu\u1ea5t, cung c\u1ea5p \u0111i\u1ec7n, vi\u1ec5n th\u00f4ng, l\u1ecdc d\u1ea7u; c\u1ea5p, tho\u00e1t n\u01b0\u1edbc;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tr\u01b0\u1eddng h\u1ee3p gi\u1ea3i quy\u1ebft c\u00f4ng vi\u1ec7c \u0111\u00f2i h\u1ecfi lao \u0111\u1ed9ng c\u00f3 tr\u00ecnh \u0111\u1ed9 chuy\u00ean m\u00f4n, k\u1ef9 thu\u1eadt cao m\u00e0 th\u1ecb tr\u01b0\u1eddng lao \u0111\u1ed9ng kh\u00f4ng cung \u1ee9ng \u0111\u1ea7y \u0111\u1ee7, k\u1ecbp th\u1eddi;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tr\u01b0\u1eddng h\u1ee3p ph\u1ea3i gi\u1ea3i quy\u1ebft c\u00f4ng vi\u1ec7c c\u1ea5p b\u00e1ch, kh\u00f4ng th\u1ec3 tr\u00ec ho\u00e3n do t\u00ednh ch\u1ea5t th\u1eddi v\u1ee5, th\u1eddi \u0111i\u1ec3m c\u1ee7a nguy\u00ean li\u1ec7u, s\u1ea3n ph\u1ea9m ho\u1eb7c \u0111\u1ec3 gi\u1ea3i quy\u1ebft c\u00f4ng vi\u1ec7c ph\u00e1t sinh do y\u1ebfu t\u1ed1 kh\u00e1ch quan kh\u00f4ng d\u1ef1 li\u1ec7u tr\u01b0\u1edbc, do h\u1eadu qu\u1ea3 th\u1eddi ti\u1ebft, thi\u00ean tai, h\u1ecfa ho\u1ea1n, \u0111\u1ecbch h\u1ecda, thi\u1ebfu \u0111i\u1ec7n, thi\u1ebfu nguy\u00ean li\u1ec7u, s\u1ef1 c\u1ed1 k\u1ef9 thu\u1eadt c\u1ee7a d\u00e2y chuy\u1ec1n s\u1ea3n xu\u1ea5t;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tr\u01b0\u1eddng h\u1ee3p kh\u00e1c do Ch\u00ednh ph\u1ee7 quy \u0111\u1ecbnh.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">C\u00e1c tr\u01b0\u1eddng h\u1ee3p \u0111\u01b0\u1ee3c t\u1ed5 ch\u1ee9c l\u00e0m th\u00eam t\u1eeb tr\u00ean 200 gi\u1edd \u0111\u1ebfn 300 gi\u1edd trong m\u1ed9t n\u0103m:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">C\u00e1c tr\u01b0\u1eddng h\u1ee3p ph\u1ea3i gi\u1ea3i quy\u1ebft c\u00f4ng vi\u1ec7c c\u1ea5p b\u00e1ch, kh\u00f4ng th\u1ec3 tr\u00ec ho\u00e3n ph\u00e1t sinh t\u1eeb c\u00e1c y\u1ebfu t\u1ed1 kh\u00e1ch quan li\u00ean quan tr\u1ef1c ti\u1ebfp \u0111\u1ebfn ho\u1ea1t \u0111\u1ed9ng c\u00f4ng v\u1ee5 trong c\u00e1c c\u01a1 quan, \u0111\u01a1n v\u1ecb nh\u00e0 n\u01b0\u1edbc, tr\u1eeb c\u00e1c tr\u01b0\u1eddng h\u1ee3p quy \u0111\u1ecbnh t\u1ea1i \u0110i\u1ec1u 108 B\u1ed9 lu\u1eadt Lao \u0111\u1ed9ng 2019.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cung \u1ee9ng d\u1ecbch v\u1ee5 c\u00f4ng; d\u1ecbch v\u1ee5 kh\u00e1m b\u1ec7nh, ch\u1eefa b\u1ec7nh; d\u1ecbch v\u1ee5 gi\u00e1o d\u1ee5c, gi\u00e1o d\u1ee5c ngh\u1ec1 nghi\u1ec7p.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">C\u00f4ng vi\u1ec7c tr\u1ef1c ti\u1ebfp s\u1ea3n xu\u1ea5t, kinh doanh t\u1ea1i c\u00e1c doanh nghi\u1ec7p th\u1ef1c hi\u1ec7n th\u1eddi gi\u1edd l\u00e0m vi\u1ec7c b\u00ecnh th\u01b0\u1eddng kh\u00f4ng qu\u00e1 44 gi\u1edd trong m\u1ed9t tu\u1ea7n.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Khi t\u1ed5 ch\u1ee9c l\u00e0m th\u00eam gi\u1edd theo quy \u0111\u1ecbnh t\u1ea1i m\u1ee5c 3 n\u00eau tr\u00ean, ng\u01b0\u1eddi s\u1eed d\u1ee5ng lao \u0111\u1ed9ng ph\u1ea3i th\u00f4ng b\u00e1o b\u1eb1ng v\u0103n b\u1ea3n cho c\u01a1 quan chuy\u00ean m\u00f4n v\u1ec1 lao \u0111\u1ed9ng thu\u1ed9c UBND c\u1ea5p t\u1ec9nh.<\/span><\/p>\n<p><b>3. Ti\u1ec1n l\u01b0\u01a1ng l\u00e0m th\u00eam gi\u1edd<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Ph\u00e1p lu\u1eadt quy \u0111\u1ecbnh ng\u01b0\u1eddi lao \u0111\u1ed9ng \u0111\u01b0\u1ee3c h\u01b0\u1edfng m\u1ee9c l\u01b0\u01a1ng cao h\u01a1n so v\u1edbi gi\u1edd l\u00e0m b\u00ecnh th\u01b0\u1eddng, c\u1ee5 th\u1ec3 theo \u0110i\u1ec1u 98 B\u1ed9 lu\u1eadt Lao \u0111\u1ed9ng 2019 \u0111\u01b0\u1ee3c h\u01b0\u1edbng d\u1eabn b\u1edfi Ngh\u1ecb \u0111\u1ecbnh 145\/2020\/N\u0110-CP nh\u01b0 sau:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">L\u00e0m th\u00eam v\u00e0o ng\u00e0y th\u01b0\u1eddng: \u00edt nh\u1ea5t b\u1eb1ng 150% ti\u1ec1n l\u01b0\u01a1ng;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">L\u00e0m th\u00eam v\u00e0o ng\u00e0y ngh\u1ec9 h\u1eb1ng tu\u1ea7n: \u00edt nh\u1ea5t b\u1eb1ng 200% ti\u1ec1n l\u01b0\u01a1ng;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">L\u00e0m th\u00eam v\u00e0o ng\u00e0y l\u1ec5, T\u1ebft, ng\u00e0y ngh\u1ec9 c\u00f3 h\u01b0\u1edfng l\u01b0\u01a1ng: \u00edt nh\u1ea5t b\u1eb1ng 300% ti\u1ec1n l\u01b0\u01a1ng, ch\u01b0a bao g\u1ed3m ti\u1ec1n l\u01b0\u01a1ng c\u1ee7a ng\u00e0y l\u1ec5, T\u1ebft \u0111\u1ed1i v\u1edbi ng\u01b0\u1eddi lao \u0111\u1ed9ng h\u01b0\u1edfng l\u01b0\u01a1ng ng\u00e0y.<\/span><\/p>\n<p><b>4.
